1 - Preamble :


These terms and conditions are concluded between Click For Foot, hereinafter referred to as "Click For Foot", and any person making a purchase from Click For Foot, hereinafter referred to as "the customer". The parties agree that their relationship shall be governed exclusively by these terms and conditions of sale.

These conditions are subject to change. It is therefore understood that the conditions applicable are those in force at the time the order is placed. The date on which these General Terms and Conditions of Sale are updated shall be deemed the effective date.

2 - Ownership :


Intellectual property.
The Click For Foot website (photos and content) is the property of Click For Foot. Any reproduction, in whole or in part, is subject to the owner's authorization. The company names, trademarks and distinctive signs reproduced on Click For Foot sites are protected under trademark law. The reproduction or representation of all or part of any of the aforementioned signs is strictly prohibited and requires the prior written authorization of the trademark owner.

Click For Foot accepts no responsibility for the content of any linked site.

Legal protection of databases.
"In accordance with the provisions of law n° 98-536 of 1er click For Foot is the producer and owner of all or part of the databases that make up this site, and has transposed Directive 96/9/EC of March 11, 1996 on the legal protection of databases into the French Intellectual Property Code (Code de la Propriété Intellectuelle).

3 - Ordering :

The contractual information is presented in French and will be the subject of a confirmation containing this contractual information at the latest at the time of your order validation.

You declare that you have read and accepted these General Terms and Conditions of Sale before placing your order. Confirmation of your order therefore implies acceptance of these Terms and Conditions.

Order validation.
Once payment has been received from the customer by credit card, bank transfer, cheque or money order, the products will be allocated to the order. Click For Foot will then confirm acceptance of the order by e-mail to the customer (at the address indicated at the time of purchase) and the sale will be concluded. Click For Foot reserves the right to cancel the order if payment is not received within 7 calendar days of the order being placed, or in the event of a payment dispute relating to a previous order. Once the goods have been dispatched, an invoice for the items dispatched will be sent to the customer.

The information provided by the purchaser when placing an order is binding: in the event of an error in the recipient's contact details, the seller cannot be held responsible for the impossibility of delivering the product.
 

4 - Availability :


Click For Foot undertakes to deliver the products selected within the limits of available stocks within a maximum of 3 weeks of receipt of order. If, however, the products are not available, Click For Foot undertakes to inform you accordingly.

If you order several products at the same time and they have different delivery times, the delivery time of the order is based on the longest delivery time. Click for foot reserves the right to split shipments.

Shipping and handling charges will only be invoiced for a single shipment. In the case of payment by credit card and split deliveries, only the products shipped will be debited.

5 - Delivery :


Delivery and delays.

You will receive electronic confirmation of the dispatch of your order. Products are delivered to the delivery address you indicated during the order process, within the time indicated on the order validation page by the customer.

The delivery time corresponds to the dispatch time indicated on the item sheet, plus the preparation and dispatch time within France (metropolitan France). In the event of delivery by a carrier requiring an appointment with the customer, the latter will contact you as soon as possible to arrange a delivery appointment, 30 days at the latest from the date of your order validation.

Please note that Click For Foot cannot be held responsible for delays in delivery due exclusively to the customer's unavailability after several proposed appointments with the carrier.

Click For Foot will be exempt from liability only in the event of force majeure, defined by the case law of the French courts as an event that was unforeseeable at the time the contract was concluded and irresistible in its execution. In any event, in accordance with legal provisions, in the event of late delivery, you have the right to cancel the contract under the terms and conditions defined in Article L 216-1 of the French Consumer Code.

Delivery and liability.
In the event of non-conformity on receipt, you must notify the carrier and Click For Foot of any reservations you may have about the product delivered (e.g. damaged or already opened package, etc.). In the case of a technical product, the customer should take particular care to check that the device delivered is in good working order, and to read the instructions supplied. You have 3 days in which to make any reservations to the carrier in the event of shortage or damage. If the delivery is incomplete or a product is damaged, you have 2 options:

1) You accept the delivery by making reservations on the carrier's delivery note.
2) You refuse the order in its entirety and write the reason on the carrier's delivery note.

When the customer personally takes delivery of the goods and when the carrier does not justify having given him the possibility of effectively checking their good condition, the 3-day period mentioned in Article L. 133-3 of the French Commercial Code, which extinguishes any action against the carrier, is extended to 10 days. For deliveries outside mainland France, the customer undertakes to pay all taxes due on the import of products, customs duties, value-added tax and any other taxes due under the laws of the country in which the order is received. Click for foot accepts no legal liability if the customer fails to pay these taxes.

If the right of withdrawal is exercised within the aforementioned period, only the price of the product(s) purchased and the shipping costs* will be reimbursed to the customer (*on a maximum flat-rate basis of €8.66 including VAT for shipping costs), with direct return costs remaining the responsibility of the customer. In the event of return of your parcel via the carrier, in this case if you have not collected your parcel from a relay point nor been available for delivery, you will be asked to pay the cost of the second shipment in the form of a payment link.

Shipping and handling.
For orders of up to 2,500 Euros, the delivery charge for France can be consulted directly on our website at the shopping cart stage. For deliveries outside mainland France, or for orders over 1,000 Euros, Click for foot will provide a special quotation to calculate delivery costs.

6 - Prices and payment :


The price is expressed in Euros (€).
The price indicated on the product sheets does not include transport.
The price indicated in the order confirmation is the final price, inclusive of all taxes and including VAT for France and EEC countries. This price includes the price of the products, handling, packaging and storage costs, transport and commissioning costs.

Prices are subject to change. Items ordered online are invoiced on the basis of the price in effect at the time the order is registered. Prices indicated on quotations are valid for 1 month from the date of the quotation. Beyond this period Click For Foot cannot guarantee the validity of the quotation. Shipping costs are indicated to the customer at the time of quotation. For deliveries outside mainland France, any customs duties or local taxes are the responsibility of the recipient.

7 - Schedule of unit prices :


The unit price list will be sent to any professional customer on request.

8 - Discounts and rebates :


Professional customers may benefit from discounts, rebates and discounts included in Click For Foot's price list, depending on the quantities purchased or delivered by Click For Foot at a single time and place, or the regularity of their orders.

9 - Right of withdrawal :


In accordance with the legal provisions in force, you have a period of 14 days from receipt of your products to exercise your right of withdrawal without having to justify your decision or pay any penalty. Once you have communicated your decision to exercise your right of withdrawal within this 14-day period, you have a further 14 days to return the product(s) concerned by the withdrawal.

The right of withdrawal can be exercised online, using the withdrawal form available on the site, or any other unambiguous statement expressing the desire to withdraw. An acknowledgement of receipt will be sent to you immediately. In the event of exercising the right of withdrawal, only the price of the product(s) purchased and the shipping costs will be reimbursed, with the cost of returning the product(s) remaining at your expense.

Returns are at the customer's expense, and must be made in their original condition, complete with accessories, instructions, etc., to enable them to be remarketed in new condition, and, if possible, accompanied by a copy of the purchase invoice for optimum management. In the event of product depreciation resulting from handling other than that necessary to establish the nature, characteristics and proper functioning of the product, you may be held liable.

In accordance with current regulations, the right of withdrawal cannot be exercised for audio, video or computer software recordings unsealed by the customer, goods made to the customer's specifications or personalized, and goods unsealed by the customer and which cannot be returned for reasons of hygiene or health protection. Click For Foot undertakes to reimburse the customer, where applicable, for all sums paid, including shipping costs and up to the amount corresponding to the cheapest standard shipping method offered on the site. Requested refunds will be processed, after receipt of the product or proof that the product has been sent, within fourteen (14) days following the exercise of the right of withdrawal by the customer.

The right of withdrawal cannot be exercised for contracts for the supply of goods made to the consumer's specifications or clearly personalized.

10 - Exchange :


The return or exchange of goods must be made within 14 days (from the date of delivery) after validation by Click For Foot of your request previously made by email: contact@clickforfoot.com or by post. It must express your wish to withdraw without any ambiguity, mentioning the order concerned by this withdrawal. Products must be returned at your expense to Click For Foot, 275 rue Henri Guillaumet, ZAC des murons, 42160 ANDREZIEUX-BOUTHEON

Returns will only be accepted if the product has not been unpacked or unsealed after delivery. The product must be returned in its original packaging, complete and intact, and in perfect condition for resale. Any product that has been damaged or whose original packaging has been damaged will not be reimbursed, taken back or exchanged.

For reasons of hygiene, the following items cannot be exchanged:

- Medical articles, pharmacy, adhesive tape, physiotherapy & osteopathy, cryotherapy & thermotherapy.

- Article strap and care band.

No exchange possible on the following items:

- Customized item (e.g. armband, chasuble, flag, etc.)

11 - Warranty :


Product conformity.

In accordance with the provisions of the legal guarantees of conformity and hidden defects, we will reimburse you or exchange products that appear to be defective or do not correspond to your order.

Under the legal warranty of conformity, the consumer has a period of two years from delivery of the goods to take action against the seller, and may choose between repair or replacement of the goods, subject to the cost conditions set out in article L. 217-9 of the French Consumer Code. The consumer is exempted from proving the existence of a lack of conformity for a period of six months following delivery of the goods. This period is extended to 24 months from March 18, 2016, except for used goods.

The legal warranty of conformity applies independently of any commercial warranty that may cover your goods. We remind you that the consumer may decide to invoke the warranty against hidden defects in the item sold, as defined in article 1641 of the French Civil Code, and that in this case he may choose between rescission of the sale or a reduction in the purchase price, in accordance with article 1644 of the French Civil Code. The provisions of this Article do not prevent you from benefiting from the right of withdrawal.

Commercial warranty.
All technical items are covered by a warranty, the duration of which varies according to the manufacturer. For all products sold on its site, Click For Foot is bound by the legal warranties of conformity (articles L.217-4 to L.217-14 of the French Consumer Code) and latent defects (articles 1641 to 1649 of the French Civil Code), in accordance with the law.

The following are excluded from any warranty: Defects in use or maintenance / Damage due to incorrect handling, abusive or abnormal use, or use for professional or commercial purposes / Spare parts or accessories whose replacement is the result of normal wear and tear, or routine maintenance operations: batteries, cables, electrodes, etc. / Transport and modification costs, in the event of a recall by the manufacturer due to a defect in the series. / Damage caused by an external event (lightning, water damage, etc.) / Intervention on the device by anyone other than the manufacturer's After-Sales Service.

12 - Applicable law - Disputes - Jurisdiction :


These terms and conditions of sale are governed by French law. Any dispute with a customer acting within the framework of his professional activity will be submitted to the appraisal of the Commercial Court of Saint-Etienne. In all other cases, the dispute will be submitted to the competent court under the conditions of common law.

Customers not acting in their professional capacity are informed that they may have recourse to conventional mediation, in particular with the Commission de la Médiation de la Consommation (Consumer Mediation Commission) or with existing sector-specific mediation bodies. In the absence of an amicable settlement directly with the professional, the latter will inform you of the name of the mediator at his disposal.

Click For Foot's liability shall in any event be limited to the amount of the order and shall not be held liable for simple errors or omissions that may have occurred despite all the precautions taken in the presentation of the products.

13 - Pre-contractual information - Customer acceptance :


Prior to placing an order, the customer acknowledges having been informed, in a legible and comprehensible manner, of the present General Terms and Conditions of Sale and of all the information and details referred to in articles L111-1 et seq. of the French Consumer Code and article L441-6 of the French Commercial Code, and in particular :

- Essential product features.
- The price of products and ancillary costs.
- The date or time by which the seller undertakes to deliver the product.
- Information concerning the seller's identity, postal address, telephone number and e-mail address.
- Information on legal and contractual warranties and how to make use of them.
- The possibility of resorting to conventional mediation in the event of a dispute.
- Information on the right of withdrawal, product return costs, cancellation terms and other important contractual conditions.

The fact that an individual or legal entity places an order on the Click For Foot website implies full acceptance of these general terms and conditions of sale, which is acknowledged by the customer, who notably waives the right to take advantage of any contradictory document, which would be unenforceable against the seller.
